Have An Entertainment License For Any Restaurant

Even having a jukebox requires an entertainment license in restaurants.


Food, drink, music and entertainment go hand-in-hand, and many savvy restaurant owners know that providing patrons with a source of entertainment can enhance the dining experience and generate good business. No matter what type of eatery you own, or kind of amusement you want to offer, you have to get some type of entertainment license or permit for a restaurant to operate legally in most states.

1. Contact your local city council to find out if your establishment meets any perquisites to obtain an entertainment license. This type of license may vary from state to state and be classified under various names. In some states you may be required to exceed certain capacities and meet building regulations regarding square footage, emergency exits and handicapped facilities. Contact your state, county or city government to find current regulations in your area.


2. Consult local zoning authorities to ensure that your restaurant is located in an area where entertainment is permitted. Some areas have strict noise and public assembly ordinances that prohibit live entertainment venues. Just because the restaurant meets with government guidelines to host entertainment does not guarantee that the government will grant permission at that particular locations. Your local zoning agency can advise you as to what entertainment permissions you might need.


3. Determine what type of entertainment permit is required for your plans. Different types of amusement are considered entertainment in the eyes of local government, and the type of events you host may call for a permit. For instance, in San Francisco you'll need a Dance Hall Keeper's license just to allow patrons to dance to a jukebox. If your restaurant has a large capacity and live entertainment such as DJs and dancing or live band performances, you may need to have a Public Hall License. Your local governing agency will direct you to the proper permits to suit your needs.


4. Start the application process and gather all required documentation. If your establishment and location require an entertainment permit, you can usually obtain all the required applications and instructions from your local government licensing agency, or sometimes download them online. Complete all forms and attach any required documentation, which might include proof of identity, zoning permissions, business plans and licenses and safety and sanitation certification.


5. Submit your application and documents to the appropriate local agency. Double-check your application for completion and possible errors and submit it with all supportive documentation related to your establishment and entertainment plans. Though specific procedures vary from state to state, typically you will return your completed application to the same city, county or state agency where it was obtained. You may also have to pay an application processing fee.


6. Wait to receive your letter of acceptance -- or denial -- after your application has been processed. The application processing and review time may vary dramatically from state to state or according to the type of restaurant you operate and entertainment you want to provide. It can sometimes take 30 to 90 days to receive an approval, and several weeks from then to be issued your permit.
